Daniel Penny jurors tell judge they can’t agree on top charge in subway chokehold case
How many of you are completely befuddled that this even made it to trial?
I predict that the Penny case is saved by the Jurors, that they cannot come to a consensus and the case gets thrown out as a mistrial.
I just wonder if it is a couple of jurors holding out on convicting or a couple (maybe one) juror who thinks he’s guilty or just not convinced he’s innocent. I gotta think the latter. It would be a travesty he is convicted.
If I was a Juror, they would hear a constant, “Perry is the exact person you want on a NY subway when a druggy nutjob threatens peoples lives!!!”
If I were the attorney, that’s all I’d focus on. And, say it over and over. I didn’t hear the closing arguments but all I’d say is that same thing over and over and over. Alvin Bragg should be disbarred and thrown in jail himself. What is wrong with people?
The NY Corner said and I quote " the victim died because of the strangle hold and nothing can convince me, even without reading the toxicology report that Penny chokehold killed this man"
The defense provided counter coroner from Texas that basically said the guy was loaded on synthetic marijuana, had sickle cell disease, known mental issues and the bones in his neck was not crushed as normal cases.
The Defense played video of other passenger who expressed great fear because of the action of the Neely, that they applauded the action of this young man. What the heck more does ther jury needed to understand?
Ah a last remember, this case is in Manhattan, has very liberal DA who brought his charge, but yet let another man off for killing a 78-year-old woman and people of NY are not really known for having common sense.

He is FOUND NOT GUILTY!
Is that for all counts? Should be. Never should have been brought to trial.
They dismissed the higher charge last week and found not guilty on the lower charge.
The tweak was that DA Bragg and the Judge was trying to pervert justice by allowing an additional charge to be considered as well (which violates the due process rule). The judge came to his senses and pulled it back.
Bragg is the stupidest DA of all time! He should be disbarred and tried for a crime.
